1. Who sells

The templates listed on the HubSpot Template Marketplace under the provider name "Emilien POINSOT" (the "Templates", including the Airdate Webinar theme and the Airdate Countdown module) are sold by Emilien POINSOT, sole trader (entrepreneur individuel) registered in France, SIRET 879 383 636 00021, 121B rue du Commandant Charcot, 69110 Sainte-Foy-lès-Lyon, France. 2. What you buy

You buy a license to use a Template, not the Template itself. The license terms are in the license.txt file shipped with each Template. In short: one HubSpot account, unlimited pages in that account, no resale or redistribution.

3. Price and payment

Prices are shown in US dollars on the HubSpot Template Marketplace listing. Payment is processed through the HubSpot Template Marketplace and the payment provider it uses (PayPal). I never see or store your card details. Free Templates cost nothing and include the same license.

4. Delivery

The Template is installed in the HubSpot account you choose right after payment. There is nothing to ship.

5. Refunds

If a paid Template does not work as described on its listing and I cannot fix the problem within 14 days of your report, you can ask for a full refund through the HubSpot Template Marketplace or by email. Refund requests for other reasons are handled case by case.

Consumers in the European Union: because the Template is digital content delivered immediately after purchase, you agree, when you buy, that delivery starts right away and you acknowledge that you therefore lose your 14-day right of withdrawal. The refund policy above still applies.

6. Support and updates

Support is by email in English and French, with an answer within two business days. Support covers installing the Template, using its settings, and fixing bugs in its code. It does not cover custom development. Updates are published through the HubSpot Template Marketplace and are free for existing buyers.

7. Liability

Templates are provided as described on their listing. To the extent permitted by law, my total liability for any claim related to a Template is limited to the price you paid for it. Nothing in these terms limits rights you have as a consumer under mandatory law.

8. Governing law

These terms are governed by French law. If a dispute cannot be solved amicably, the competent courts are those of Lyon, France, except where mandatory consumer law gives you the right to go to the courts where you live.
